By purchasing EC VR, you agree to EC’s terms of service below and to: (i) the Oculus Terms of Service (www.oculus.com/legal/terms-for-oculus-account-users/) if an Oculus account is used to access Oculus products; or (ii) the Supplemental Oculus Terms of Service (www.oculus.com/legal/terms-of-service/) together with the Facebook Terms of Service (www.facebook.com/legal/terms/) if your Facebook account is used to access Oculus products.
Regardless of whether you previously purchased the Oculus Quest 2 VR headset or purchased said product as a consequence of your enrolment in this course, you may not and agree not to hold EC responsible or liable for any damage, injury or adverse consequences relating to the Oculus and the usage and functioning of the Quest 2 VR headset. In this regard, please note the relevant Oculus Health and Safety Warning document (www.oculus.com/legal/health-and-safety-warnings/).
1. PAYMENTS FOR COURSES WITHOUT THE OCULUS
Payments shall be made either by bank transfer or credit card, and must be received in full and in cleared funds not less than 3 business days prior to the course start date. For the purpose of this clause, the term “working day” means a day (excluding Saturday and Sunday) on which banks generally are open for the transaction of normal banking business, apart from the Public Holdings mentioned below. A one-week tuition deposit must be paid by credit card or by bank transfer immediately upon booking.
No new bookings will be received after Wednesday for programs starting the following Monday.
A booking confirmation will only be sent when the full payment has been received. Bank details are provided on the invoice. All bank transfer charges (including intermediary bank charges) shall be borne by the payor and accordingly, the payment is to be grossed up with such additional costs.
2. PAYMENTS FOR COURSES WITH THE OCULUS
Payments shall be made by bank transfer or credit card, and must be received in full and in cleared funds at time of booking for the 12 weeks of the course.
No new bookings will be received after Wednesday for programs starting the following Monday.
A booking confirmation will only be sent when the full payment has been received. Bank details are provided on the invoice. All bank transfer charges (including intermediary bank charges) shall be borne by the payor and accordingly, the payment is to be grossed up with such additional costs.
3. REFUND AND CANCELLATION FEES
If EC cancels a programme after a student’s enrolment, EC will refund all monies received as at the date of cancellation less the cost paid for the OCULUS
All refunds are made to the original fee payer.
Refunds will be made within 45 calendar days of the documented date of cancellation.
Course cancellation prior to the course start date
(WITHOUT OCULUS)
Students cancelling their course up to 14 calendar days prior to the course start date shall be entitled to a full refund of fees received by EC following the deduction of a 50 Euro non-refundable registration processing fee.
Students cancelling or postponing their course anytime within 14 calendar days (inclusive) prior to the course start date, will be charged a cancellation fee equivalent to 1 week of tuition.
Course cancellation prior to the course start date
(WITH OCULUS)
To students cancelling 14 days or more prior to the course start date, EC will refund fees received in full minus the 400 Euros constituting the full cost of the OCULUS and the 50 Euros non-refundable registration processing fee.
Students who are cancelling or postponing in less than 14 days prior to the course will be charged a cancellation fee equivalent to 1 week of tuition.
Course cancellation, reduction after the course start date
In the event that following the start date of a student’s course, the relevant student fails to attend any one or more sessions in the course, or joins any one or more sessions late, or further to the student’s request, the course hours are reduced, cancelled or shortened, the student shall not be entitled to any refund of the fees relating to the said course. No changes to the schedule will be accepted.
The student shall not be entitled to any form of refund, reduction in fees, any form of credit or additional sessions in lieu of sessions missed due to technical issues originating from student’s internet connection or faulty equipment.
In the unlikely event that EC would be responsible for technical difficulties obstructing student’s ability to follow the sessions, a make-up session will be issued to the student corresponding to the missed sessions.
4. CHANGES TO ENROLMENT
EC reserves the right to charge an administration fee of 50EUR each time a student elects to change his / her course after EC has confirmed the initial enrolment.
No changes can be made to a student’s program once a course week has started.
A downgrade in course type after booking is considered a cancellation and the same refund policies will apply.
5. PUBLIC HOLIDAYS FALLING ON A WEEKDAY
Public Holidays: New Year’s Day, Good Friday, Easter Monday, Christmas Day and Boxing Day
Any public holidays that occur during a student’s program will appear on the booking confirmation and there is no refund for sessions missed due to a public holiday.
All published course start dates fall on a Monday; however, if this day is a public holiday, the course will begin on the following working day.
6. VIRTUAL CLASS INFORMATION
Courses run from Monday to Friday and are scheduled in chosen times zones.
EC reserves the right to change the timetable structure.
7. PHOTOGRAPHY/FILMING & RECORDING
Kindly go through the below consent form regarding the use of photographs, videos, artwork or other works, as well as recorded or written testimonials (together, the “Works”) thoroughly. These may be used, stored or transferred internationally by EC, or by a third party for promotional purposes including printed and online marketing materials and on any social media network. Should students not wish to be present within photographs or videos, they are kindly requested to absent themselves from the area in which such photographs or videos are being taken/recorded, and duly return to the area once such has ceased. Online sessions may be recorded for quality and training purposes.
Each student hereby grants EC, who accepts, a worldwide, non-exclusive, transferable sub-licensable and royalty free license to use any Works (including any intellectual property vesting over or within such Works) for promotional purposes including printed and online marketing materials and on any social media network.
8. DATA PROTECTION
Any information provided to EC may be held on computer and shall be used in accordance
with its data protection registration and the national data protection laws applicable. EC may
disclose appropriate personal data to relevant EC staff and third parties where there is a legitimate need or obligation to do so and where disclosing the information and the manner of disclosing the information complies with national privacy laws. We will not share sensitive information about students with any third party, including parents, legal guardians, caregivers, next of kin, or relevant government agencies without the student’s consent unless there are reasonable grounds to believe that it is in the student’s vital interests to do so in instances where the health, safety and/or welfare of the student and/or others is at risk, if any identified special needs are affecting the student’s ability to participate, learn and achieve in an EC programme and/or where the law requires us to do so. 9. LIABILITY
EC and its staff and representatives will not be liable for loss, damage, injury or death to persons or
property howsoever caused, except where liability is expressly imposed by law. EC will not be
liable in the event that any service contracted to be supplied by EC becomes impossible to supply for any reason or any cause outside the control of EC.
10. FORCE MAJEURE
EC shall not be responsible for any failure to comply with any of its obligations if the failure is occasioned by any cause beyond EC’s reasonable control and despite the exercise of reasonable diligence and without incurring additional costs, cannot be prevented or avoided. Force majeure events shall include but shall not be limited to, act of government, war, threat of war, riot, civil strife, general labour disturbance, such as a boycott, strike, lockout, or ‘go slow’ directives’, terrorist activity, natural or nuclear disaster, rolling blackouts, cloud computing outages, cyber-attacks, unusually adverse weather conditions, closure of an EC Centre, infectious diseases, viruses, plague, epidemic or pandemic health crises (caused by viruses such as Ebola, H1N1, H5N1, Zika, COVID-19, and other communicable known and unknown diseases), or any action taken by a government or public authority, including prohibition of entry into a country or region of a country, promulgation of quarantine measures, ordering the “lockdown” of the whole or part of a country.
It is acknowledged that the epidemic health crisis in connection with COVID-19 and any related quarantine and actions of a governmental authority shall be considered a force majeure event for the purpose of these EC Terms and Conditions, even though the health crisis has arisen prior to the effective date.
11. AGENTS
EC Terms and Conditions are applicable to all students and agents.
12. VALID PRICES
Prices are valid from October 2021. Prices are subject to change without notice and will be confirmed upon invoicing.
